Platform use and service agreement
These Terms govern access to and use of the BotLinkd website, business messaging platform, Android application, APIs, webhooks, integrations, automation, AI-assisted features and related services.

BotLinkd is provided for authorised business messaging, team collaboration, automation and connected operational workflows.
Customers are responsible for recipient opt-in, lawful messaging, accurate data and compliance with Meta, WhatsApp and applicable laws.
Paid subscriptions and services are non-refundable once processed, except where applicable law requires otherwise or a verified billing error occurred.
Active customers receive standard product and technical support without a separate standard support fee.
By creating an account, purchasing or renewing a service, accepting an order, connecting an integration or using BotLinkd, you agree to these Terms and the policies incorporated by reference. If you act for a company or other organisation, you confirm that you have authority to bind that organisation.
These Terms form a legally binding agreement between the person or organisation using BotLinkd (“Customer”, “you” or “your”) and BotLinkd (“BotLinkd”, “we”, “us” or “our”).
You may use BotLinkd only if:

If a signed agreement or written order expressly conflicts with these Terms, the signed agreement or written order controls only for the specific conflicting subject.
BotLinkd is an independent enterprise SaaS business messaging platform built on the official WhatsApp Business Platform Cloud API. BotLinkd is not owned or operated by Meta.

You agree to:
BotLinkd may require identity, business, phone-number or payment verification before activating or continuing certain services. You must not misrepresent an identity, business, brand, authority or relationship with another person or organisation.
You are responsible for:
BotLinkd provides tools and infrastructure. You control your messaging purpose, audience, content, customer relationships and business decisions.
You agree to:
Meta or WhatsApp may reject templates, restrict messaging, change pricing, reduce limits, suspend numbers, disable accounts or alter platform access. Those actions are controlled by the relevant third-party provider, not BotLinkd.

You must not use BotLinkd to:
As between you and BotLinkd, you retain your lawful rights in customer contacts, messages, templates, files, business knowledge and other content you submit to the service (“Customer Content”).
You grant BotLinkd and its authorised service providers a limited, non-exclusive right to host, transmit, reproduce, transform and otherwise process Customer Content only as reasonably necessary to:

BotLinkd may provide AI-assisted replies, classification, summaries, retrieval from approved business knowledge and related automation. These features are intended to support a business’s own customer communication and operational workflows.
BotLinkd may change, limit or disable an AI configuration where necessary to comply with third-party policy, law, safety, infrastructure or product requirements.
Relevant WhatsApp Business Solution terms may change over time. Customers remain responsible for ensuring their AI use case remains permitted by the current provider terms.
API keys, secrets, tokens and webhook credentials are confidential account credentials. You must store them securely and must not expose them in public code, client-side applications, screenshots, tickets or repositories.

BotLinkd may revoke or rotate credentials, apply rate limits or restrict an integration when required for security, stability, billing, abuse prevention or policy compliance.
Third-party integrations may change or stop functioning because of provider updates, permission changes, outages or discontinued APIs. BotLinkd does not control those third-party decisions.
The BotLinkd Shopify app may be offered without a separate app subscription fee. This does not mean that every connected service is free.
Depending on configuration, charges may still apply for:
Shopify and other third-party platforms are governed by their own terms, permissions, review processes and availability. You authorise BotLinkd to exchange the data necessary for the integrations you install and configure.
Paid BotLinkd services are billed according to the selected plan, invoice, order, quotation or written service scope. Billing may be monthly, annual, usage-based, one-time or another agreed frequency.
BotLinkd may change pricing prospectively. Material changes to a recurring BotLinkd fee will be communicated through the website, account, invoice or another reasonable channel before they apply to a future renewal, where required.
Meta, WhatsApp and other providers may change their own charges, billing categories or pricing independently. BotLinkd may pass through or reflect those provider changes where applicable.
BotLinkd does not automatically include or activate a free trial on the website, during registration or within a paid package.
A prospective customer may request a guided demo or limited trial. Any evaluation is provided only after BotLinkd confirms its availability, duration, features, usage limits and conditions.
Public product demonstrations may also be available through BotLinkd’s official YouTube channel.
BotLinkd does not provide refunds or prorated credits for unused time, change of mind, non-use, selecting the wrong billing period, partial billing periods, cancellation after renewal or account restriction caused by customer conduct.
You may cancel a recurring subscription through available billing controls or by contacting support. Cancellation:

Standard support does not automatically include custom development, extensive migration, managed campaigns, dedicated personnel, third-party system repair, custom integration work, on-site service or specialised consulting. Those services may require a separate written scope and fee.
Response and resolution times vary according to priority, complexity, account access, provider dependencies and support volume. Unless a signed service-level agreement states otherwise, support targets are not guaranteed response or resolution commitments.
BotLinkd works to maintain a secure and reliable service, but does not guarantee uninterrupted, error-free or universally available operation unless a signed service-level agreement expressly states otherwise.
Availability may be affected by:
BotLinkd may add, modify, replace, limit or discontinue features to improve the service, respond to provider changes, protect security or comply with law. Where reasonably practical, material changes to a paid core feature will be communicated in advance.
BotLinkd and its licensors retain all rights in the platform, software, interfaces, designs, documentation, workflows, trademarks, branding and technology, excluding Customer Content and third-party materials.
Subject to payment and compliance with these Terms, BotLinkd grants you a limited, non-exclusive, non-transferable, revocable right to access and use the purchased service for your internal authorised business purposes during the applicable service period.
You must not:
Feedback may be used by BotLinkd without restriction or payment, provided it does not identify confidential Customer Content.
Each party may receive non-public business, technical, security, pricing or operational information from the other. The receiving party will use reasonable care to protect confidential information and use it only for the relationship contemplated by these Terms.

Disclosure may be made where required by law, regulation or valid legal process, subject to available notice and protective measures.
BotLinkd may restrict, suspend or terminate access when reasonably necessary because of:
Where appropriate and legally permitted, BotLinkd may provide notice or an opportunity to correct an issue. Immediate action may be taken for security, fraud, abuse, legal compliance or urgent provider enforcement.
You may stop using the service and cancel renewal in accordance with the Refund & Cancellation Policy. Termination does not eliminate payment obligations, liabilities or provisions intended to survive, including confidentiality, intellectual property, disclaimers, indemnity and liability limits.
To the maximum extent permitted by applicable law, BotLinkd is provided on an “as available” and “as is” basis. Except for an express written commitment, BotLinkd disclaims implied warranties including merchantability, fitness for a particular purpose, non-infringement and uninterrupted availability.
BotLinkd does not warrant that:
You are responsible for evaluating whether BotLinkd is suitable for your use case and for implementing appropriate human review, backups, consent, compliance and business-continuity measures.
Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
To the maximum extent permitted by law, BotLinkd and its affiliates, personnel and suppliers will not be liable for indirect, incidental, special, exemplary, punitive or consequential loss, or for loss of profit, revenue, goodwill, opportunity, anticipated savings, reputation, data or business interruption.
To the maximum extent permitted by law, BotLinkd’s aggregate liability arising from or relating to the service will not exceed the BotLinkd fees actually paid by the Customer for the affected paid service during the three months immediately preceding the event giving rise to the claim.
This limitation applies regardless of the legal theory and even if a remedy fails of its essential purpose, but does not apply where prohibited by applicable law or superseded by a signed written agreement.
To the extent permitted by law, you will defend, indemnify and hold harmless BotLinkd, its affiliates, personnel and suppliers from third-party claims, losses, penalties, damages, costs and reasonable legal fees arising from:
BotLinkd will provide reasonable notice of an eligible claim and cooperation at your expense. You must not settle a claim in a way that admits fault by or imposes an obligation on BotLinkd without written consent.
BotLinkd may update these Terms to reflect service, provider, legal, security or commercial changes. The revised version will be published with a new effective date. Where appropriate, material changes may also be communicated through email, account notice or the platform.
BotLinkd may provide notices through the account, registered email, invoice, website or another reasonable electronic method. You are responsible for keeping account contact details current.
You may not assign or transfer the agreement without BotLinkd’s prior written consent. BotLinkd may assign the agreement in connection with a merger, reorganisation, financing, sale of assets or transfer of the relevant business.
Neither party is responsible for delay or failure caused by events beyond reasonable control, including natural disasters, conflict, labour disruption, internet or utility failure, cyberattack, government action, provider outage or third-party platform change. This does not excuse payment obligations already due.
If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue. Failure to enforce a provision is not a waiver.
These Terms and incorporated documents form the entire agreement regarding the service unless a signed agreement or written order states otherwise. A signed agreement controls over an order form; an order form controls over these Terms; and these Terms control over general website or sales materials for the same subject.
Any governing-law, jurisdiction or dispute provision stated in a signed agreement, order form or invoice applies. If none is stated, applicable law determines the governing law and competent forum. Before filing a formal claim, the parties should first attempt in good faith to resolve the issue through written notice and reasonable business escalation, except where urgent injunctive or protective relief is required.
These Terms do not limit statutory consumer, privacy or other rights that cannot lawfully be waived, although BotLinkd is primarily offered as a business-to-business service.

Include your registered email, business name and relevant invoice, order or account details. Do not send passwords, complete payment-card data or unnecessary sensitive information.
